If you are facing a lengthy sentence and are still in the local jail, you do have options. One such option is a Motion to Reconsider. A Motion to Reconsider is a request submitted to the sentencing Judge requesting that the Judge entertain a different, less harsh sentence at a Motion to Reconsider hearing. The Motion to Reconsider is a last resort and its success can be only be measured by saying "it is a long shot."

A Motion to Reconsider involves a two stage process. At the first stage, a written Request or Motion to Reconsider is made citing and making reference to the reasons why the Judge should reconsider the sentence previously imposed. At this first stage in a Motion to Reconsider process, it is important to attach and present all supporting documentation (i.e. mitigating evidence from employers, family, and other sources) to the Request or Motion to Reconsider. At this first stage, the Judge has the discretion to deny the request WITHOUT even having a court hearing on the Motion to Reconsider. However, if the Court grants a Motion to Reconsider hearing, the second stage includes preparing for and presenting your case to the Court at the Motion to Reconsider hearing.
